Terms and Conditions

Vzpomínkář – Terms of Service

This English text is provided for convenience. The Czech version is the binding one.

These terms and conditions (the “Terms”) govern access to and use of the Vzpomínkář digital service (the “Service”) and the sale of paid features to consumers at a distance.

Effective from 2 November 2026. Version 2.2.

1. Service provider

Lukáš Stuchlík, company ID (IČO): 03185311, registered at Nad Řekou 3005, 390 02 Tábor, Czech Republic. A self-employed person trading under a Czech trade licence.

E-mail: info@mujvzpominkar.cz · Phone: +420 775 183 735 · Web: https://www.mujvzpominkar.cz

That e-mail is also the contact point for questions, complaints and defect claims (the “Provider”).

2. What the Service is

Vzpomínkář lets users record spoken stories, convert them to text, refine their wording, organise them into chapters and turn them into a digital book, diary or album, including PDF export and sharing via a link.

Artificial intelligence is used purely as a technical tool for transcription and wording. It never adds content that was not said in the recording.

The Service is not an archival, legal, medical, therapeutic or historical service and does not provide professional advice.

3. Functionality, compatibility and technical requirements

To use the Service you need:

  • a device with a microphone and an up-to-date mainstream web browser,
  • an internet connection throughout recording and processing,
  • microphone permission in the browser; recording is impossible without it,
  • a device able to open PDF files if you want to download an output.

No installation is required. Recordings, transcripts and generated outputs are stored by the Provider and accessible after signing in. The current scope of features and their limits are shown in the app before the order is completed.

4. User account

Most features require an account. The user undertakes to:

  • provide accurate and current information,
  • protect their sign-in credentials,
  • report any suspected unauthorised access without delay.

The user is responsible for activity carried out through their account.

5. Price and payment

The first 15 minutes of recording are free for every story. They are enough to produce a complete sample book, which the user can read, download as a PDF and share.

Further recording is unlocked by a one-off payment of CZK 499 per story, which adds 600 minutes of recording time. This is not a subscription: it does not recur and needs no cancellation.

The price stated is final. The Provider is not registered for VAT.

Payments are processed by Stripe. The Provider never receives card details. Available payment methods may differ by device, browser and country.

6. Orders and formation of the contract

An order is completed using a button that expressly states the obligation to pay. Before pressing it, the user can review these Terms, the Privacy Policy and the Refund Policy.

The contract is concluded when the payment gateway confirms the payment. Only then is the purchased recording time unlocked.

Confirmation of the contract, these Terms and confirmation of the consent under clause 7 are sent to the user by e-mail.

7. Right of withdrawal

A user who is a consumer may withdraw from a distance contract within 14 days of its conclusion, without giving a reason.

For digital content not supplied on a tangible medium, that right is extinguished if performance began before that period expired, the user gave prior express consent, was informed that the right would be lost, and the Provider supplied confirmation of that consent.

Because recording time unlocks immediately after payment, the Provider collects that consent before payment through a separate checkbox. Without it an order cannot be completed; the user may continue using the Service within the free allowance.

A withdrawal notice may be sent by e-mail or post to the address in clause 1; the model form in the annex may be used. Where a refund is due, the Provider returns it within 14 days by the same means it was received, unless agreed otherwise.

Beyond the statutory periods, the Provider considers every refund request individually and in good faith, in particular where the Service did not work as it should have.

8. Defective performance and complaints

The Provider is liable for the Service matching its description, agreed scope, functionality and compatibility, and for it being free of defects while provided.

The following are not defects:

  • transcription inaccuracy caused by a poor recording, noise or unclear speech,
  • factual inaccuracy of the story itself,
  • short outages caused by maintenance, a supplier failure or force majeure.

Complaints can be raised by e-mail at info@mujvzpominkar.cz; please describe the defect, when it occurred, the device used and the account e-mail. The Provider confirms receipt and resolves the complaint without undue delay, for consumers within 30 days at the latest unless a longer period is agreed.

Where a complaint is justified, the user is entitled in particular to removal of the defect, a reasonable discount or withdrawal from the contract under statutory conditions. Statutory consumer rights cannot be limited by these Terms.

9. User content and licence

All uploaded content remains the user's. By submitting content the user declares that:

  • they are entitled to provide it,
  • they have the consent of people whose voice, likeness or personal data it captures,
  • it infringes no third-party rights or laws.

The user grants the Provider a non-exclusive, revocable licence to store and technically process the content solely in order to provide the Service. Content is never used for marketing or for training AI models.

10. Duration and termination

The user may delete their account at any time in account settings; deletion is irreversible and removes all content.

The Provider may restrict or terminate access in the event of a breach of these Terms, misuse of the Service or unlawful conduct.

Purchased recording time is tied to one story and is not transferable.

11. Liability

The Provider is liable for damage to the extent set by law. It is not liable for the factual accuracy of the stories or for decisions made on their basis.

No limitation of liability applies where mandatory law excludes it, in particular to statutory consumer rights and to damage caused intentionally or by gross negligence.

12. Out-of-court dispute resolution and supervision

A consumer may refer a dispute that cannot be settled directly to the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, https://adr.coi.cz. We recommend contacting the Provider first.

Consumer protection is supervised by the Czech Trade Inspection Authority. Data protection is supervised by the Office for Personal Data Protection, https://www.uoou.gov.cz.

13. Changes and governing law

The Provider may amend these Terms and will give reasonable advance notice of any significant change by e-mail or in the app. Contracts already concluded are governed by the version in force when the order was placed.

These Terms are governed by Czech law, without prejudice to mandatory consumer rights. They exist in Czech and English; the Czech version prevails.
