Terms and Conditions

These terms and conditions (the "Terms") govern access to and use of the Vzpomínkář digital service (the "Service").

By accessing or using the Service, you confirm that you have read and understood these Terms and that you agree to them.

1. Service provider

At this stage the Vzpomínkář service is operated by Lukáš Stuchlík as a natural person, without an established company.

If a company is established, these details (business name, registered office, company ID) will be updated and users will be informed.

2. Description of the service

Vzpomínkář is a digital platform for recording, processing and structuring personal life stories.

The Service allows users to:

• record audio interviews and spoken storytelling,
• convert speech to text,
• apply language and stylistic editing,
• structure stories into chapters or thematic sections,
• generate personal outputs (including text files, PDFs or print-ready formats).

The Service uses artificial intelligence solely as a technical processing tool.

The Service is not an archival, legal, medical, therapeutic or historical service, and it does not provide professional advice of any kind.

3. User account

Some features of the Service require a user account.

By creating an account, the user agrees to:

• provide accurate and up-to-date information,
• protect their login credentials,
• prevent unauthorized access to the account.

The user bears full responsibility for all activity carried out through their account.

4. User content

Users may upload, create or otherwise provide content, including:

• audio recordings,
• texts and transcripts,
• photographs and documents,
• personal and family stories.

By submitting content, the user represents and warrants that:

• they have the legal right to provide such content,
• they have obtained all necessary consents from the people mentioned in it,
• the content does not infringe third-party rights or applicable law.

The user bears sole responsibility for all content submitted to the Service.

5. Ownership and licence

All user content remains the exclusive property of the user.

The user grants the Provider a non-exclusive, limited and revocable licence to process the content solely for the purpose of:

• operating and providing the Service,
• technical processing (including processing by AI),
• generating the outputs the user requests.

User content is never used for marketing or promotional purposes without explicit consent.

Aggregated and anonymized data may be used to improve the Service.

6. Service outputs

All outputs generated by the Service are intended solely for the user's personal use.

The Provider does not guarantee:

• the factual or historical accuracy of memories,
• the completeness of the narrative,
• the objectivity or interpretive correctness of the generated outputs.

7. Pricing and payments

At this stage the Service is provided free of charge as a public beta intended to gather user feedback. No payments or subscriptions are currently required.

In the future the Service may also be offered as a one-off paid service or on a subscription basis. Current pricing will always be shown on the Service's website.

8. Termination

Users may cancel their account at any time.

The Provider reserves the right to suspend or terminate access if the user:

• breaches these Terms,
• misuses the Service,
• engages in unlawful conduct.

9. Limitation of liability

The Service is provided "as is".

To the maximum extent permitted by law, the Provider is not liable for:

• emotional, psychological or personal effects of the content,
• loss of data for reasons beyond reasonable control,
• indirect, incidental or consequential damages.

10. Changes to the Terms

The Provider reserves the right to change these Terms at any time. Updated versions will be published on the website.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the Czech Republic.
